Labour councillor in custody over sex charges

Mark Burton

A COUNCILLOR has been remanded in custody and suspended by his party after being charged with two sexual offences.
Mark Burton was arrested only days after this month’s council elections and was charged with two offences, one against a child.

Councillor Burton was re-elected to serve the Harrowgate Hill ward on Darlington Borough Council for a second four-year term on May 5.

The 42-year-old Labour councillor was arrested three days later and charged with an offence of sexual assault and a second for sexual touching of a child.

He later appeared in front of magistrates in Newton Aycliffe, where he was remanded in custody until his next hearing on June 15. No pleas have yet been entered.

He has been suspended by his party pending the outcome of the investigation.

New council leader Bill Dixon referred The Northern Echo to the party’s regional group yesterday.

A Labour North spokesman said: “Coun Mark Burton has been placed on an administrative suspension from the Labour Party and Darlington Labour Group pending the outcome of police inquiries. “He is unable to hold any position with, or represent, the Labour Party during his suspension. “It would be inappropriate to comment further until police investigations are complete.”
A spokeswoman at Darlington Borough Council said: “Coun Mark Burton has been charged with two offences of a sexual nature.
“The case is still being investigated by the police and the usual child protection procedures are being followed. "We understand that he is currently remanded in custody. “The councillor has been suspended from the Labour group and has therefore not been put forward for seats on any of the committees. “At this stage, the council does not have powers to take any action to suspend him.”
She added that ward matters in Harrowgate Hill would be dealt with by the two other Labour councillors – John Vasey and Marjory Knowles.

Conservative Councillor - Sexual Harassment

A FORMER Lord Mayor has been suspended after he got drunk at an official ball and made lewd sexual comments to two female colleagues.

Councillor Andy Matchet was hosting the Lord Mayor's Ball in Coventry last year when he approached two women and told one: ''I'd like to f*** you''.

Cllr Matchet — who was wearing his ceremonial gold chains at the time — also talked about having orgasms and boasted about losing his virginity.

The 57-year-old, of Coventry, admits downing wine and cocktails and claims he can only remember ''some aspects'' of the evening.

He said: ''I am an extremely argumentative person. It is the sort of comment I would have made as part of an argument about radical feminism.

"I would have said it argumentatively, not invitationally. "I'd had several glasses of wine and was on medication because of my bad back, including paracetemol, Codeine, Ibuprofen and dodo tablets, an over the counter low level amphetamine."

The outburst came during a conversation between the then Lord Mayor, the council's equality and diversity policy officer Laura Slegg, and a third woman named only as 'Miss X'.

Laura, 27, told the council's standard's committee: ''He asked how old she was and he said how old he was.

"He twice said he'd like to f*** her and twice asked if she'd like to f*** him. The three of us had been talking about orgasms and he told us how old he was when he lost his virginity."

Conservative Councillors suspended after sex claims

Hmm

Two married Conservative councillors have been suspended amid allegations they have been hosting group sex sessions at their Wolverhampton home.

To their neighbours, David and Carol Bourne are pillars of the community. Both represent Wednesfield North and have been heralded as leading lights in the campaign to triumph in the next general election.

Their future is uncertain after being suspended, amid allegations they have been inviting people to their Merry Hill home to take part in sex acts.

Reports have claimed that the pair have been charging people up to £150 to take part in lewd activities behind the curtains of their immaculate end-of-terrace house in Telford Gardens.

The couple are alleged to have advertised their “services” in an adult magazine using the same contact number as their political websites.

One shocked neighbour, who did not want to be named, said the Bournes appeared to be a respectable couple.

He said: “We can’t believe it. We always thought they had a lot of visitors but we just assumed they were friends.”

Last year David, a governor at St Bartholomew’s Primary in Penn, was unveiled as one of a trio of councillors picked by the Tories to head up their Black Country campaign team.

The 66-year-old – first elected in 2003 – is one of the authority’s senior councillors, as cabinet member for children and young people and a member of the standards committee.

Carol, aged 49, was elected last year as commentators hailed the David Cameron-effect for the party winning extra seats in the city.

Councillor Peter Bilson, deputy leader of Wolverhampton City Council until Labour was ousted in the May elections, said: “If this is fact they would lead to resignations. This is not good for the council.”

Leader of the Tory-Lib-Dem alliance at Wolverhampton City Council Neville Patten declined to comment, saying only: “They are suspended pending an investigation.”

The couple were today unavailable for comment.

The leader of the council's Lib Dems confirmed Mr Griffiths, who represented Aberystwyth's Rheidol ward, had quit.

Mr Griffiths stood down at the weekend.

"I can confirm the resignation, which took place over the weekend," said Ceredig Davies. "I have no further statement to make at the moment."

Conservative Politician accused of sex attacks

A Tory politician has been suspended by his party after being charged with a series of sex attacks against young girls.

Stephen Mullins appeared before magistrates last week accused of two indecent assaults on females, the rape of another and assault on two further females. All were under the age 16.

He entered no plea and was remanded in custody to appear at a later date.

The married chef, of Links Avenue, Norwich, is a long-serving member of the Norwich North Conservative Association and has served on Hellesdon Parish Council for several years, representing the south east of the community.

It is alleged that the attacks took place over a period of five years but only recently came to light following a police investigation.

At least one of the alleged victims is now an adult. The women cannot be identified for legal reasons.

Last night Shelagh Gurney, chairman of the association, confirmed she had sought legal advice following the charges and the Conservative party area office had been informed. She said Mr Mullins' membership had been temporarily suspended awaiting the conclusion of the case.

She added: “The charges are of a very serious nature and we have got to treat them as such. However, for the time being he is innocent until proven guilty and we are awaiting the outcome of the case.”

A source added that colleagues were shocked by his arrest but were determined to keep an open mind about the charges. But they said the allegations come as an embarrassment in what should have been a positive week for Norwich Tories after they won two seats at the city council elections.

Despite serving on the council for about three years, Mr Mullins, who is in his 40s, is thought to have only sporadically attended meetings.

He has worked as head chef in the kitchen of the Bull pub in Reepham Road, Hellesdon, for 17 years.

No decision has been made on his continued employment at the pub.

He was also banned from the council for one month after appearing drunk at an official ceremony.

Update 27 March 2008

A councillor facing sex charges broke down and wept as colleagues paid tribute to him.

Mark McCarthy is quitting after nine years as a Worthing borough councillor before the May 1 local elections.

Coun McCarthy, 36, who represents Offington as an independent Tory after being expelled by the ruling Conservative group, is to stand trial at Oxford Crown Court on July 2 on two counts of indecent assault on a young boy between February 27 and December 31, 2002.

At the last council meeting before the elections, Coun Reg Green, a senior Tory and fellow Offington ward councillor, said: "I shall be very sad to see Mark go. He has been a very good councillor in my ward, a great stalwart, and assisted me when I was canvassing.

"I have had many compliments from constituents about Mark and what he has done."

His tribute was greeted with applause by both parties, before Lib Dem councillor Hazel Thorpe said: "I think you are very brave to be here today."

Coun McCarthy wept as Mayor Heather Mercer presented him with a book on Worthing before kissing him on the cheek.

Deputy leader Coun Ann Barlow also went to speak quietly to Coun McCarthy before he left the council chamber.

Two long-serving Lib Dem councillors, former mayor Geraldine Lissenburg and John Lovell, are also standing down.

Coun Lissenburg, who represents Broadwater, served for 20 years, and Coun Lovell, of Tarring ward, 17 years.

There were calls for both to be made aldermen but Coun Lovell declined and said: "I think honorary aldermen should be abolished."

UPDATE 3 October 2008

A former councillor has been cleared of sexually assaulting a baby.

But Mark McCarthy was found guilty of intimidating a witness in the case.

A judge put off sentencing the 37-year-old ex-stockbroker but told him he was not likely to be sent to prison.

During his trial the seven women and five men on the jury had been told by prosecutor Alan Blake that McCarthy had indecently assaulted the tiny child on two separate occasions a few weeks apart - the first when his victim was just three months old.

When he learned he was being prosecuted he then phoned the child's mother twice, warning her he had naked photographs of her which he would send to the newspapers if she testified against him.

"You're f***** either way, darling, you really are," he told her.

Today the jury at Oxford Crown Court took four hours and 40 minutes to clear him of indecent assault on a male person.

They had returned a guilty verdict on the lesser charge of witness intimidation with the intention of perverting the course of justice, earlier in the day.

The judge reassured McCarthy, a former Conservative member of Worthing Borough Council, West Sussex, that he would not be sent to jail for his crime.

He urged him to begin addressing his alcohol problem, which was thought to be at the root of the trouble which brought him before the court.

Judge Anthony King also hinted that alcohol abuse treatment was likely to be a central part of any future sentence.

The baby's mother had given evidence that in 2002, on an occasion when McCarthy had been visiting, her son was lying in her bedroom, naked from the waist down, having just been bathed or while having his nappy changed.

The mother, who cannot be identified for legal reasons, alleged McCarthy had been nuzzling the child when he suddenly indecently assaulted it.

As he did this the woman let out a stunned laugh, bringing her daughter into the room and they both looked at each other in shock.

The mother did not report the incident, which was repeated a few weeks later, during another nappy change.

This time the woman said she told McCarthy: "It's wrong. Don't you ever do that again."

According to her he seemed surprised by her reaction. He responded: "I only did it because it made you laugh the first time."

Confused by what had happened, the woman did not report the incident to the authorities but told friends, who urged her to.

It was only when one of the people she had confided in contacted the police that a full criminal investigation was launched.

Prosecutor Mr Blake said after the police became involved and McCarthy was specifically told not to contact the woman, he made his threatening phone call.

"He said he was going to publish the pictures of her in the papers to prove he was not a paedophile," he said.

"He knew perfectly well that she was a witness and those calls were clearly intended to dissuade her from coming to court."

From the start McCarthy maintained his innocence, claiming the allegations were motivated by malice on the part of the baby's mother.

He described the alleged attack as "a perfectly innocent act."

Following the verdicts, Judge King, sitting at Oxford Crown Court, said: "I think there are unusual circumstances in this case and a pre-sentence report would be helpful.

"One of the issues it should address is the abuse of alcohol."

He told McCarthy: "Unless something unusual happens between now and then I don't propose to pass a custodial sentence.

"I am concerned that you have to do something about your alcohol abuse."

He ordered the Probation Service to prepare pre-sentence reports on the defendant, of Offington Drive, Worthing, West Sussex.

McCarthy was told to return to Oxford Crown Court on October 31 to be sentenced.

UPDATE 4/11/2008

A former Tory councillor has been spared jail despite threatening a woman testifying against him in a court case.

Mark McCarthy, a former member of Worthing Borough Council, was given a 20-week jail term, suspended for 12 months, after a jury convicted him of intimidating a witness.

The former stockbroker phoned the woman twice after learning she had claimed he indecently assaulted her baby son.

At Oxford Crown Court, McCarthy, 37, was cleared of any sex attacks but found guilty of intimidation.

The judge considered how to punish McCarthy, who has a serious alcohol problem, after the former councillor wasted a pre-sentence report session with the probation service by turning up drunk.

Labour councillor Denies Paying Teenager For Sex

A 62-YEAR-OLD former councillor sat in the witness box yesterday and denied paying a teenage girl for sex.

Richard Manser's alleged sex partner, Joanne McKenna, now 20, is on trial accused of robbing him at knifepoint.

Manser denies giving McKenna cash for sex for three years, starting when she was 16.

The ex-Labour councillor, who quit after the scandal, insisted he did not admit to prosecutors in the case that he had a sexual relationship with the young woman.

And he compared his friendship with McKenna to the relationship between Henry Higgins and Eliza Doolittle in George Bernard Shaw's famous play Pygmalion.

In the play, Higgins turns street urchin Eliza into a fine lady by teaching her to speak properly.

Asked by McKenna's advocate why a man of 60 would have a relationship with a teenage girl, Manser replied: "I hesitate to mention the name of George Bernard Shaw but there was a bit of Pygmalion involved.

"I am no Henry Higgins and she is no Eliza Doolittle but she was a waif and needed a father figure. I was quite happy to help her."

McKenna, her dad and her then boyfriend deny attacking Manser with a Bowie knife and a Samurai sword and putting him through a two-hour ordeal at his home in Paisley near Glasgow.

Prosecutors claim the trio stole Manser's bank card and McKenna used it to withdraw £600.

Manser told the High Court in Glasgow that McKenna was "a friend and a nuisance" who was always pestering him for cash for cigarettes.

He said she came to his flat on the night of the attack, asked for money, then went to buy cigarettes.

Manser said McKenna then burst back into his home with her father Thomas McKenna and a man he didn't recognise.

He claimed Thomas McKenna was brandishing a Bowie knife and the other man had a Samurai sword.

Manser said that in the two hours that followed, Thomas McKenna hit him on the head with the Bowie knife and guided a kitchen knife in his daughter's hand to "dig" it into the side of his face.

He said his wrists were bound with plastic ties and a sponge was put in his mouth and held with tape.

Manser claimed Joanne McKenna left the flat with his bank card. He said Thomas McKenna told him that if she came back empty handed, he was dead.

Manser quit Renfrewshire Council and the Labour Party after Joanne McKenna spoke to a paper about their alleged relationship.

McKenna's counsel, Sarah Livingstone, accused him of falsely accusing her client of the attack and telling police "a pack of lies" to get back at her. He replied: "I emphatically deny that."

Manser admitted owning porn videos but denied showing them to Joanne McKenna. He also denied asking to film her as she took part in unnatural sexual activity with him.

The witness told Miss Livingstone he quit the council to get a redundancy deal and left the Labour Party because he did not agree with Tony Blair and Gordon Brown.

But after the judge warned him that he had to answer the questions, he admitted the party suspended him after a complaint from Joanne McKenna, and he resigned.

Manser said he was "completely exonerated" by the Committee on Standards in Public Life.

Joanne McKenna, Thomas McKenna, 40, and Joanne's then boyfriend Michael Collins, 25, deny forcing their way into Manser's flat on December 7 last year, detaining him against his will, assaulting him to his severe injury and robbing him of his bank card. Joanne McKenna also denies using the card. The trial continues.

Redsell is also deputy mayor of Woodbridge.

UPDATE 1 Jul 08

A SUFFOLK county councillor's career has been left in tatters after he pleaded guilty to a sex assault and a string of child pornography offences - despite previously maintaining his innocence.

Ben Redsell, 28, of Melton, near Woodbridge, admitted sexual assaulting a 19-year-old woman, seven counts of making indecent pictures of children and three counts of possessing indecent pictures of children.

The town, district and county councillor for Woodbridge had previously pleaded not guilty to the offences and in November said: “I maintain my innocence and I will be fighting all these charges.”

But standing in the dock at Norwich Crown Court yesterday,Redsell pleaded guilty to each of the 11 counts read out to him.

He admitted sexually assaulting a 19-year-old woman, who cannot be named for legal reasons, at her home on August 24 last year following a night out at The Hippodrome in Colchester.

Following his arrest, police searched Redsell's home in Melton Meadow Road, where he lives with his mother.

Officers found indecent images of children on his computer and yesterdayhe pleaded guilty to seven counts of making indecent pictures of children dating from January 1, 2000, to August 26, 2007.

He also pleaded guilty to three counts of possessing indecent images of children, which police found in his bedroom, for the same period.

Judge Simon Barham told Redsell, who was elected as a Conservative county councillor, that he would be sentenced on August 1 - the day after his 29th birthday - and ordered him to sign the sex offenders' register.

Judge Barham added: “Do not assume that because you are on bail now you will not get a custodial sentence later.”

Before attending court yesterdayRedsell resigned from his positions at Suffolk County Council, Suffolk Coastal District Council and Woodbridge Town Council.

In a letter to the district council, Redsell said: “It has been an honour to serve the people of Woodbridge as their councillor for the last year and I am very sorry to be leaving in this way.”

Speaking after the case, Les Binns, the mayor of Woodbridge, said: “I think it is a sad event and very unfortunate. Some people in the town are feeling let down and the council itself feels let down. He was a lad with some promise which he has given up. Until today people were asking what was happening to him and said that they missed him because he did a lot of good work for the town. But I am sure that now he has pleaded guilty there may well be a different attitude. People are all shocked and dismayed.”

Redsell, a former pupil of Farlingaye High School and Woodbridge School, was elected to Suffolk County Council at a by-election in 2004, becoming the youngest member of the authority.

He was elected to the district council in May last year, as the councillor for Woodbridge Riverside ward.

He held numerous positions at all three tiers of local government, including membership of Suffolk Police Authority. He was also the Conservative agent in Ipswich before the 2005 General Election.

Redsell resigned from the Conservative Party in November after he was charged with the offences to “save them any further embarrassment” but continued to act as an independent councillor.

Suffolk police's Detective Inspector Steve Clabburn said: “These are serious offences and we are pleased he has pleaded guilty, which has spared the victim the ordeal of having to face him in court.

“The guilty plea was made in light of the evidence gathered by officers and we will await the sentencing.”

A Suffolk County Council spokesman would only comment by confirming that Redsell resigned from the council at 2pm yesterday.

There will now be two by-elections to fill his seat for the county council and district council, although it is not yet known when these will take place.

Redsell declined to comment yesterday.

Conservative Mayor - Pornography

David Lee
David Lee
COUNCILLORS will attend an extraordinary meeting this week following the resignation of Chelmsford's mayor David Lee amid allegations that illegal pornography from the internet was downloaded onto his computer.

The borough council members will choose and appoint a new mayor and deputy to serve for the remainder of the civic year, which runs until May.

The East Anglian Daily Times understands that the mayor's role will be taken by Conservative councillor Nicolette Chambers, although this has not been formally announced.

Ms Chambers is currently deputy mayor and a councillor for the Chelmsford Rural West ward.

Her replacement as deputy mayor will also take place at the meeting.

Fellow Tory Mr Lee resigned on November 9 following claims illegal pornography had been downloaded onto his council laptop.

The father-of-three, who has not been arrested, also resigned as a councillor for the Moulsham and Central Ward.

He has been told he will not be able to continue his role as vice-governor of the Boswells School in Chelmsford until a police investigation into the allegations against him is completed.

Mr Lee's laptop was seized from his home earlier this month and specialists from Essex Police's high-tech crime unit are analysing it.

The investigation is expected to take months rather than weeks as police try and work out when any images were viewed and how many people had access to the computer.

Chelmsford Borough Council and 44-year-old Mr Lee, who worked in the banking and IT sectors, issued a joint statement at the time confirming his resignation.

It said: “This follows an ongoing police investigation in relation to alleged inappropriate use of computer equipment belonging to Chelmsford Borough Council.

“Full co-operation is being given to the police by the mayor and the council in an investigation, which is likely to last several months.”

Essex Police confirmed there had been an allegation from the council that one of its computers had been used to access “sexually explicit images”.

Sex-surf councillor gets his seat back

A MAN forced to resign from Allerdale and Maryport councils for using council computers to surf sex sites has been co-opted back on to Maryport Town Council.

It has been alleged by a former town mayor that Kevin Smith was voted back by councillors trying to keep out a BNP candidate.

As a result, ex-mayor Tony Johnstone has resigned from the Labour group in protest and is now sitting as an Independent councillor.

Mr Smith, of Camp Road , Maryport, quit Allerdale after being confronted with a list of adult website pages he had visited. He had signed a code of conduct which stipulated that the council’s computers were not for personal use.

Mr Smith, 42 at the time, had represented Maryport on Allerdale’s Netherhall Ward for 10 years and had been a councillor for 18 years.

He quit both positions and also resigned as secretary of Labour’s Solway branch.

Mr Smith could not be contacted this week but at the time of the incident he said he had gone on to the websites to see what the internet was all about. He said: “It was just the curiosity of a red-blooded male.”

Keith Little, leader of Maryport’s Labour group, said: “He had been looking up sites with material you can see on television after 9pm any day of the week.”

Coun Little denied that Mr Smith had been readmitted to council to keep out a BNP candidate.

He said: “We had four vacancies to fill on the council. We advertised them and we received nominations, including one from a BNP candidate. When the council voted on the nominations, Mr Smith was among the winners.

“It is a long time since he broke council rules. He was a good councillor and, from what I understand, he still gets people approaching him on council business.”

But Coun Johnstone said he believed that Labour members had chosen Mr Smith over Stephen Harris, a BNP candidate, because they were concerned about having a BNP councillor.

He said: “Stephen is a local lad. He was not standing for council because of any interest in national politics but because he wanted to serve Maryport.”
